Syllabus

<p>1. Public Lands. Lease. Timber cutting by trespasser. Compromise. Sixteenth section.</p> <p>The owner of the lease to a sixteenth section has such an interest in the timber growing on the land as will entitle him to recover damages for the wrongful removal of the timber by a third person, even though after the timber was cut from the land there remained on the land a plenty of timber for estovers.'</p> <p>2. Same.</p> <p>In such case the owner of the lease may recover on a note given him in compromise by one who has wrongfully c.ut timber thereupon.</p>
