<p>SYLLABUS BY THE COURT.</p> <p>1. An “account stated’’ is an account balanced and rendered, with an assent to tbe balance, express or implied, so that tbe demand is essentially tbe same as if a promissory note bad been given for tbe balance. P. 184</p> <p>2: All that is necessary to be shown, in order to sustain an action on an account stated, is tbe absolute, unqualified, unconditional, and voluntary admission by tbe defendant, or his agent, and tbe plaintiff, or bis agent, before tbe bringing of the suit, of tbe existence of a specified sum of money as a present, existing debt, which admission may be express, or may be inferred from tbe conduct of tbe parties.</p> <p>P. 184</p>
