Syllabus

<p>NON-SUIT — TRIAL BY COURT.</p> <p>The court upon a trial without a jury may grant a non-suit at the close of plaintiff’s evidence, on the ground that a fair preponderance of the proof established facts preventing recovery by plaintiff, although there is evidence tending to sustain plaintiff’s claim.</p>
