Syllabus

<p>Appeal — Review—Findings. Under Rem. & Bal. Code, § 1736, requiring a trial de novo, on appeal in actions legal or equitable tried to the court, the findings of the trial court are treated with respect, but will be set aside if the supreme court is convinced that they are against the preponderance of the evidence.</p>
