REPORTED OPINION AND ORDER denying-in-part and granting-in-part the government&039;s [18] Motion to Dismiss pursuant to Rules 12(b)(1) and 12(b)(6). The government&039;s Motion to Dismiss [18] as to Count I and II under RCFC 12(b)(6) is denied. Court III of Plaintiff&039;s [15] Amended Complaint is dismissed without prejudice under RCFC 12(b)(1) for lack of subject-matter jurisdiction. The government is DIRECTED to file an Answer to the Amended Complaint by February 24, 2026. The parties are directed to file a Joint Preliminary Status Report by March 10, 2026
