Syllabus

<p>Evidence — Competency of witness—</p> <p>In an action of trespass by an administrator against a sheriff to recover damages for an alleged wrongful sale of goods belonging to the estate of the decedent, a person who has signed the bond to indemnify the sheriff against loss by reason of the sale, has an interest adverse to the decedent, and is incompetent to testify as to matters occurring prior to the decedent’s death.</p>
