Syllabus

Trial court did not abuse its discretion when it awarded a $2,397.50 sanction against a pro se litigant for filing a motion for attorney fees after it found the motion frivolous under R.C. 2323.51. The trial court did, however, commit reversible error when it relied on evidence outside the pleading when it granted a Civ.R. 12(B)(6) motion to dismiss.
