KOLOAMATANGI, 23 I&N Dec. 548 (BIA 2003) ID 3486 (PDF) An alien who acquired permanent resident status through fraud or misrepresentation has never been “lawfully admitted for permanent residence” and is therefore ineligible for cancellation of removal under section 240A(a) of the Immigration and Nationality Act, 8 U.S.C. § 1229b(a) (2000).
