Syllabus

<p>Will — Testamentary capacity — Evidence.</p> <p>The fact that the testator was personally attending and successfully carrying on a retail drug business of considerable value, at the time he executed his will, and for over five years afterwards, is sufficient evidence of testamentary capacity, although the testimony showed that he was eccentric, peculiar, slovenly in his attire, conduct, conversation, and personal habits.</p> <p>An issue devisavit vel non will not be awarded where the testimony to sustain it, viewed in the most favorable light, would not warrant a jury in rendering a verdict against the will.</p>
