Syllabus

<p>Action under Sections 3838 and 3839, General Code — For injuries inflicted by a dog — Exemplary damages not recoverable — Question of evidence.</p> <p>1. In an action brought under Section 4212-2, Revised Statutes (General Code, Sections 5838 and 5839), for injuries inflicted by a dog, punitive pr exemplary damages are not recoverable.</p> <p>2. In such an action, evidence tending to show the dog had bitten another person prior to the time that the plaintiff was bitten, and that defendant had knowledge thereof, is inadmissible.</p>
