<p>Error to Madison.</p> <p>1. Costs— criminal cause. Neither the state nor a county is bound by law to pay the fees of officers in prosecutions in behalf if the people where no conviction is had ;■ and where the defendant is convicted the officers must look to the defendant’s estate for their costs, and run the risk of losing them if he be insolvent.</p>
