<p>Taking of private property — For improvement of living stream■ — ■ Violates Article I, Section ip of Constitution — Invalidity of Section 4567c, Revised Statutes.</p> <p>The amendment, in parenthesis, to Revised Statutes, Section 4567c, passed March 23, 1893 (90 O. L., 123), authorizes the taking of private property in the improvement of, and removal of an obstruction from a living stream for the public benefit without compensation to the owner, in violation of Article I., Section 19, of the constitution, and is therefore null and void.</p>
