Syllabus

The defendant, Greenville Public Library, appealed from a Superior Court entry of summary judgment in favor of the plaintiff, Key Corporation. On appeal, the defendant argued the hearing justice erred in declaring that it was a public body and, therefore, should not be subject to the Access to Public Records Act (the APRA). The defendant also contended that the hearing justice erred in assessing the amount of attorneys' fees awarded for the plaintiff.<br><br>The Supreme Court held that the trial justice properly granted the motion for summary judgment of the plaintiff. The Court determined in reviewing the undisputed facts that the defendant is a public body. The Court determined that there was a clear basis for the award of attorneys' fees once the hearing justice determined that the defendant violated the APRA and acted well within his discretion.<br><br>Accordingly, the Supreme Court affirmed the judgment of the Superior Court.
