Syllabus

The defendant, Marysol Krikorian, appeals from a Family Court decision and order denying her motion for relocation with the parties' minor child. The defendant asserted that the trial justice overlooked or misconceived material evidence in coming to his decision. The Supreme Court concluded that the trial justice weighed each of the relevant factors in arriving at his decision and pointed to the evidence that prompted that decision. The Supreme Court concluded that, in light of the deference accorded to the trial justice, who is in the best position to determine what factors are relevant to the case and to weigh the credibility of the parties, there was no error in the decision denying the motion to relocate. The Supreme Court also directed that the issue of child support, which is not a bartering tool but for the care of the child, be addressed by the Family Court. Accordingly, the Supreme Court affirmed the order of the Family Court and remanded the case for further proceedings.
