<p>Where usurious interest on a note to a national bank is included in a renewal note, without an agreement that the renewal note shall be a payment of the old one, and the renewal note is subsequently merged in a judgment which is afterwards paid in full, the penalty provided by the act of Congress for charging arid receiving usurious interest on loans, cannot be enforced.</p>
