<p>Principal and agent — Letter of attorney — Limitations on power of attorney.</p> <p>Where a letter of attorney by a mother to her sons gives general power over real and personal property but provides that, “nothing herein contained shall give them or either- of them power and authority to sell, convey, mortgage, pledge or otherwise encumber the said property,” the sons cannot bind their mother by a contract for the preparation of plans for a building involving an outlay of from $50,000 to $60,000, where it appears that such an outlay could only be made by encumbering the mother’s real estate, and that as a matter of fact the building project was abandoned, and the mother received no benefit in any way from the plans prepared.</p>
