Syllabus

<p>The case of the plaintiff, in an action against a city to recover damages for personal injuries received, showing simply that, while driving upon a paved street, forty feet wide, the plaintiff’s horse shied and drew the carriage against a rise at the side from twelve to eighteen inches high, throwing the plaintiff out, no question of negligence on the part of the defendant was presented, and it was not error to direct a judgment of nonsuit.</p>
