The plaintiff, Joan Strassman, appealed from an order of the Superior Court denying a motion to charge the garnishee, IGT Global Solutions Corporation, now known as Brightstar Global Solutions Corporation, in satisfaction of a judgment awarded in favor of the plaintiff and against the defendant, Karen Howe. The plaintiff challenged the Superior Court's decision not to impose liability for the full amount of the judgment pursuant to G.L. 1956 § 10 17 15, and Brightstar cross appealed challenging the statute's constitutionality as implicated in the plaintiff's appeal. The Supreme Court concluded that § 10-17-15 requires a trustee to be found liable for the full amount of the judgment only when a trustee refuses or neglects to render the account required under that statute. The plaintiff conceded, however, that Brightstar Global Solutions had not refused nor neglected to render an account. Accordingly, the Supreme Court affirmed the order of the Superior Court.
