Jeane Whitfield v. Dennis K. Schimpf

Jeane Whitfield brought this medical malpractice action against Dr. Dennis Schimpf alleging Schimpf was negligent in performing breast augmentation-mastopexy surgery on Whitfield and in rendering post-operative care. The court of appeals affirmed a jury verdict in favor of Schimpf. We find the trial court erred by excluding evidence of bias Whitfield offered to impeach the testimony of Schimpf's office manager about her sexual relationship with Schimpf along with other evidence of the office manager's bias toward Schimpf. We reverse and remand for a new trial.
