<p>SYLLABUS BY THE COURT.</p> <p>Sections 5739'and 5743, inclusive, Code 1915, providing for condemnation of right of way over lands of another for1 acequia purposes, are unconstitutional in that they make no provision for notice to the owner of the ueeting of the appraisers for the purpose of fixing the damages, nor opportunity to be heard thereon.</p>
