<p>SYLLABUS (BY THE COURT.)</p> <p>1. Where the defendant admits liability and advises and requests plaintiff to bring suit in order to dispose of the conflicting claims of a third party and for no other purpose, he will not, after plaintiff has begun suit and incurred costs, be permitted to deny liability.</p>
