<p>Contract — Patents—Royalties—Affidavit of defence.</p> <p>Where a person has agreed to pay royalties on all sales that he may make of an unpatented device, he cannot allege as a defence, in an action for the royalties, that, after the agreement was entered into, a patent for the device was refused by the patent office.</p>
