<p>Road law — Report of viewers — Confirmation—Refusal of court to rescind confirmation — Notice.—Counsel.</p> <p>An order of court refusing to rescind an order of confirmation in a road case, on the ground that the appellant had no .notice of the hearing on exceptions, will not be reversed, where it appears that the case has been in progress for twelve years during which the appellant had represented certain property first as agent of the owner, and after the death of the owner as trustee, that the same attorney had been counsel during the whole period, and that this counsel had notice of the exceptions and participated in the hearing. In such a case the appellant cannot say that counsel was not authorized to represent him, and that he had not had a day in court.</p>
