Syllabus

The probate court abused its discretion by not holding a hearing on appellant's Civ.R. 60(B) motion for relief from the court's certificates of transfer. Appellant's motion alleged operative facts that would warrant relief by asserting that he is the decedent's son and is entitled to a one-third share of the decedent's real property. Judgment reversed and remanded.
