In re Elana W.

Syllabus

The respondent biological father appealed from a decree terminating his parental rights to his daughter. He maintained that the decree should be vacated because the trial justice erred in finding that there was sufficient evidence to support a finding of parental unfitness. The Supreme Court determined that the trial justice did not err in finding parental unfitness due to the respondent's failure to cooperate with DCYF. The Supreme Court noted that, although the respondent completed some of the objectives of the case plans, he was uncooperative with other aspects and was unwilling to fully engage in the services provided by DCYF. Accordingly, the Supreme Court affirmed the decree of the Family Court.
