<p>APPEAL — EFFECT OF BEVEKSAL UPON KETKIAL OF CASE.</p> <p>The decision of the appellate court upon a cause which has been remanded for re-trial can be held to be the law of the case only to the extent that the facts developed upon the re-trial are the same as those upon which the appellate court has passed.</p>
