Syllabus

<p>1. The courts of the state have exclusive jurisdiction to enforce a contract to pay royalties for the use of a patented invention, when the parties are both residents of the state.</p> <p>2. Where the specifications of claim in letters patent for an improved method or process cover the use in such method of several distinct mechanical appliances, the licensee or assignee of the patent is liable for the stipulated royalty though he use but one of the appliances, unless his liability is clearly and distinctly limited.</p>
