Syllabus

<p>Negligence.—The duty to use ordinary care in supplying a proper road-bed and track of a railroad, and in keeping that roadrbed and track in repair, is incumbent on a railroad corporation. It cannot escape the consequences of the negligence of the agents whom it lias charged with a duty of that nature; and this whether the injury complained of as resulting from a defective road-bed is inflicted on a fellow-servant of the corporation or another.</p>
