Syllabus

The plaintiff appealed from the trial court's judgment of possession for the defendant tenant on count one of the seven count complaint in the plaintiff's summary process action. The plaintiff claimed, inter alia, that the court failed to render a decision with respect to the remaining counts of the complaint, which contained independent grounds for eviction. Held: This court dismissed the appeal for lack of subject matter jurisdiction, as the trial court rendered an express judgment only as to count one of the complaint and, pursuant to Meribear Productions, Inc. v. Frank (328 Conn. 709), the trial court's ruling on count one did not implicitly resolve the remaining counts of the complaint, all of which alleged legally consistent theories that, if proven, would support eviction of the defendant, and, thus, the appeal was not taken from a final judgment.
