<p>EQUITABLE LIEN—-WHAT CONSTITUTES-PROMISE TO PAT OUT OB PARTICUIiAB FUND.</p> <p>An agreement in a mortgage that 25 per cent, of the money realized from sales by the mortgagor of the lands mortgaged, and also of certain other described lands, which are not included in the mortgage, shall be set apart as a fund for the payment' of the mortgage debt, does not create an equitable lien in favor of the mortgagee or his assigns against the lands not expressly mortgaged.</p>
