<p>Homesteads — When Attaches — Mortgage Prior to Declaration —Separate Property oe Husband. Tbe selection by a wife of a homestead from the husband’s separate property does not defeat the lien of a prior mortgage thereon taken from the husband in good faith; since, under Bal. Code, §'5246, the homestead right attaches only “from and after the time the declaration is filed for record,” regardless of occupancy.</p>
