Syllabus

<p>1. A Sheriff is not authorized to receive money for a plaintiff on mesne process and where a defendant gave in evidence a receipt of the Sheriff, and mesne process issued before on the same note on which he was sued, it was held that he was not thereby discharged.</p> <p>2. A payment thus made, is not a payment to the official agent of the plaintiff, acting under his authority. .</p> <p>3. The 21st Section of the Act of 1839, in relation to the office and duties of Sheriff, makes no change in the law in this respect.</p>
