<p>[To be reported.]</p> <p>In. an. action by an executor or administrator based on a claim in favor of tbe estate, a legatee or distributee, wbo bas parted with bis interest either by release, payment or assignment, is a competent witness for tbe plaintiff, unless there is some other ground of exclusion than the fact that he is a legatee or distributee.</p>
