<p>New Trial — Newly Discovered Evidence — Discretion op Court. It is not an abuse of discretion to refuse a new trial on tbe ground of tbe newly discovered evidence of a witness wbo would testify, in contradiction of several witnesses, tbat plaintiff bad told bim several years before tbat be was ruptured and unable to do bard work, where tbe same was contradicted by counter affidavits, and it is not probable tbat tbe evidence would change tbe result.</p>
