Syllabus

<p>If the debtor at the time of, or previous to, payment, neglects to designate to which of several debts he applies his payment, his right to control the application is gone, and the creditor may exercise it at any time before suit.</p> <p>The institution of suit, evidences the creditor’s application of the payment.</p>
