Syllabus

<p>Where A agreed to deliver a horse to B on a given day, at a stipulated price, but before the day, sold it to another, and did not deliver it on the day appointed, it was held, that B was entitled to maintain an action for the breach of the contract, without averring or proving his readiness and ability to pay the money; the wrongful act of A having excused him from making- such averment an^proof.</p>
