<p>CONTRACT — CONSTRUCTION.</p> <p>1. A company engaged in the business of boring irrigation wells and also of selling irrigation pumps, contracted to bore a well, and in a separate contract took an order for a pump for the well. The pump was no part of the well proper, but was to be set in a pit to be dug after the completion of the well, which pit was not to be dug by the company. Held, that a clause in the contract for' boring the well that the company should set the pump did not necessarily imply that it was to transport the pump from its establishment in the town out to the pit where it was to be set.</p> <p>(Syllabus by the Court.)</p>
