<p>1 A demurrer tests tbe cause of action as stated in tbe declaration and not tbe measure of damages.</p> <p>2. A cause of action arises immediately upon tbe wrongful discharge of an employee under contract for a definite time, and it is not necessary to await tbe termination of that time.</p> <p>3. A declaration entitled “In tbe Circuit Court of tbe Eleventh Judicial Circuit, in and for Dade County, Florida,” sufficiently states tbe venue in- tbe margin.</p>
