Syllabus

<p>Waters — Diversion of stream — Water Companies — Preliminary injunction.</p> <p>A preliminary injunction restraining a water company from using a six-inch pipe where it formerly used a three-inch pipe in taking water from a stream will not be continued if it appears that the mere use of the larger pipe will not materially decrease the flow of water in the stream to the injury of a lower riparian owner.</p>
