Syllabus

<p>Fraudulent Conveyances — Sales in Bulk — Creditors. One to whom an order tor 5,000 cigars had been given for future delivery is not a creditor of the party giving the order until some portion of the cigars have been delivered, within the meaning of the sales-in-bulk act, requiring an affidavit as to creditors upon a sale of a stock of goods in bulk.</p> <p>Appeal — Review—Findings. The findings of the trial court who had the advantage of seeing and hearing the witnesses, will not he disturbed where the evidence is conflicting and irreconcilable.</p>
