<p>Malicious Prosecution (§ 21*) — Defenses— Statement to Prosecuting Officer.</p> <p>. Where, in an action for damages for alleged malicious prosecution and false imprisonment, it appears that defendant had made a full and fair statement of the case to the prosecuting officer, and was guided by his instructions in malting the affidavit upon which the prosecution complained of was based, there can be no recovery.</p> <p>(Syllabus by the Court.)</p>
