Syllabus

The trial court did not err when it denied appellant's motion for sanctions, attorney fees, and costs. Appellee's malpractice suit against appellant, who was a court-appointed expert accountant, did not constitute frivolous conduct warranting sanctions pursuant to R.C. 2323.51(A)(2)(a)(ii) and Civ.R. 11. Judgment affirmed.
