Syllabus
<p>Syllabus.</p> <p>1. As to half of lot 125, it fell into the community existing between the father of plaintiff and her step-mother, as the evidence does not show that it was bought with the separate funds of the father (defendant’s husband and plaintiff’s father).</p> <p>2. Amount collected on a policy of insurance of which the stepmother was the beneficiary was properly collected by her as her separate property.</p> <p>3. Amounts the evidence sustained, were charged, and other amounts the evidence did not sustain, were rejected.</p> <p>4. The surviving spouse of a second marriage is not entitled to the usufruct of property inherited by a child of the first marriage.</p>
