Syllabus

1. In a bill in equity to recover slaves, there is a call for a discovery of facts, which the evidence shows the plaintiffs knew at the time, or had the means of knowing. If this call for a discovery be the only ground of equity jurisdiction, the bill should be dismissed, with costs.

2. In a suit to recover slaves against an adverse claimant, the fact that the title to the slaves depends upon the construction of a provision in a will, is no ground of equitable jurisdiction.

3. The fact that there are more claimants than one of slaves in the adverse possession of others, and that distribution-among the claimants will be necessary if the slaves are recovered, is no ground of equitable jurisdiction.
