H-N-, 22 I&N Dec. 1039 (BIA 1999) ID 3414 (PDF) The Immigration Judge and the Board of Immigration Appeals have jurisdiction to adjudicate an alien's request for a waiver of inadmissibility pursuant to section 209(c) of the Immigration and Nationality Act, 8 U.S.C. § 1159(c) (1994 & Supp. II 1996), following the initial denial of such a waiver by the Immigration and Naturalization Service.
