<p>1. Railroad. Fellow servant. Constitution 1890, Sec. 193. Code 1892, l 3559.</p> <p>Constitution 1890, § 193, touching the application of the fellow-servant rule in the case of railroad employes', has no application to an action based on the negligence of the railroad company itself, in failing to provide a safe road bed.</p> <p>2. Same. Contributory negligence.</p> <p>Facts considered, and the defense of contributory negligence adjudged not to have been made out.</p>
