<p>1. Evidence — Res Gesms — Statement oe Person Injured.</p> <p>A declaration by a man who bad fallen into an excavation for a sewer in the night, and received a fatal injury, that there was no light there, made some 10 minutes after the fall, during a conversation with a person above, and in answer to a direct question, goes beyond a statement respecting the immediate cause of the injury, which was the fall, and is inadmissible as a part of the res gestee.</p> <p>Y1.
