<p>Breach of Marriage Promise — Incurable Disease as Defense— When Agreement Not Binding — Public Policy. A marriage contract is void as against public policy where one of the parties is seriously afflicted with pulmonary tuberculosis and the other has a hereditary taint of such disease, even though the parties were aware of the facts prior to the engagement.</p>
