Syllabus

<p>Where the purchaser of real estate by articles, covenants, in consideration of the reduced price at which the real estate is sold, to assume and discharge a liability of the vendor to a third person, which is evidenced by the assignment of a judgment against the vendor, recovery thereof may be had from the vendee, in assumpsit by the plaintiff in the judgment to the creditor’s use.</p>
