Syllabus

<p>Sheriffs and Constables—Powers—Presumptions. It will be presumed that a constable and town marshal, holding the two offices within separate territorial jurisdictions, assumes to act in making an arrest as the officer of the territorial jurisdiction wherein he attempted to act.</p>
